The Bill to Amend the Law Passes, Disability Pension to Apply to All Persons with Disabilities

The bill amending Law No. 4/2010 (Social Security System) was passed in detail today (July 2) by the Legislative Assembly.  The bill will come into effect on October 1, cancelling the application requirement of Article 37(1)(b) of the Law that “the disability must occur after a person qualifies as a beneficiary”, so that the disability pension can be universally applied to all persons with disabilities, thus reflecting the fairness of the system.

At present, provided that a person with disabilities, who has been in a disability status before qualifying as a beneficiary of the social security system, satisfy the legal requirements, he or she can apply for a temporary disability allowance paid by the Social Welfare Bureau and the amount is equal to the disability pension of the Social Security Fund in order to obtain basic living security.  After the entry into force of the bill, all persons with disabilities can apply for disability pension from the Social Security Fund as long as they meet other legal requirements and those who are currently receiving temporary disability allowance will automatically become beneficiaries of disability pension.
